This Privacy Policy (the "Policy") describes how Shenzhen Apeman Innovation Science & Technology Co., Ltd. and our affiliates (collectively "Nooie", "Apeman", "we", "our" or "us") handle and process your personal information.

The policy covers how we might collect, store, use, and/or share personal information when you interact with us, such as when you:

  • Use our Nooie products
  • Interacts with our Nooie App.
  • Communicate with us by email, text, through online request forms, or any other ways provided by us

Please take a moment to familiarize yourself with our privacy protection practices. This privacy policy excludes information collected through third-party websites, applications, or content, including advertisements, and any third-party’s data processing practices.

If there is a conflict between the notice or the privacy statement of a specific website or feature provided at the time of collecting information and this Policy, the specific notice or supplementary privacy statement will prevail. 1. How We Collect Your Information

For the purposes of this Policy, "personal data" refers to any information relating to an identified or identifiable natural person.

Apeman collects information in order to operate more efficiently and provide you with better product experience. The personal data is collected from (1) your direct provision of personal data, (2) data we record about how you interact with our products, (3) third parties which we obtain your personal data indirectly.

The information we collect depends on the environment in which you interact with Apeman products and personnel, the choices you make, including your privacy settings, and the products and features you use.

1.1 Information provided by you

Some of our services will need you to provide us with your information directly.

Account: For the creation of your account, we ask users to provide us with a username, email address, and region information. We will also ask for these account credentials when you login to the account. If you choose to change your profile avatar, we will need to have access to you mobile phone camera.​

Order information: If you make an after-sale or warranty request, we will ask you to provide the product order information, your contact information, address, email address, mobile phone number, so that we may respond to your request.

1.2 Information automatically generated and collected

1.2.1 Application

Permissions:

For the provision of services for specific devices and/or to enable additional features, we may collect and use the following information with your consent. Please note that, if you do not provide such information, you would not be able to access these additional features. However, you may continue to use basics Services of the App and connected to devices.​

Additional functions based on location information:

When you enable the location-based functions through permission settings on your mobile device, we will collect and process your location information to enable these functions, such as pairing with your devices.

Additional services for accessing and uploading images/pictures based on photo albums (picture library):

This product features the ability to set profile pictures and scan QR codes, which requires camera permissions to take photos.

The product offers a feature to save to the phone’s gallery, requiring read and write permissions to save and access photos and videos in the device’s gallery.

Additional services based on camera:

You may use the camera to scan the code by turning on the camera permission to pair with a Smart Device, take video, etc. Please be aware that even if you have agreed to enable camera permission, we will only obtain information when you actively use the camera for scanning codes, video recording, etc.

You can use the microphone to send voice information after turning on the microphone permission, such as double-way communication, waking up the voice assistant, etc. For these functions, we will collect your voice information to recognize your command. Please be aware that even if you have agreed to enable microphone permission, we will only obtain voice information through the microphone when you voluntarily activate the microphone in the App.

Additional services based on storage permission:

The purpose is to ensure stable operation of the App by utilizing storage permission. After you give or indicate the permission to read/write your mobile device’s storage, we will access pictures, files, crash log information and other necessary information from your mobile device’s storage to provide you with functions such as information publications, or recording the crash log information locally.

Additional services based on notification permission:

The reason why we ask you for permission is to send you notifications about using the products and services, especially if you have purchased security services and you require an alert or message so that you can capture the real-time status.

Additional services based on Bluetooth permission:

You can enable Bluetooth functions after turning on the permission, including controlling the Smart Devices, acquiring device status, and device network configuration. In these functions, we will communicate with terminal devices via Bluetooth. Please be aware that even if you have agreed to enable the Bluetooth permission, we will only use Bluetooth for communication in these scenarios: display device status on the home page and device panel; perform device control on the home page and device panel; we will use it on the home page and the add device page, for discovering the devices via distribution network.​

Please note that if you turn on any permission, you authorize us to collect and use relevant personal information to provide you with corresponding Services. Once you turn off any permission, we will take it as a cancellation of the authorization, and we will no longer continue to collect Personal Data based on the corresponding permissions, and the related functions may be terminated. However, your decision to turn off permission will not affect previous collection and use of information based on your authorization.

1.2.2 IoT devices and network

Device information: including information about the attributes of your device, for example, your mobile phone’s model number, operating system version, device screen size, unique device identifier, international mobile equipment identity (IMEI) number, network device hardware address (MAC address); device location information, for example, location information obtained via GPS, Bluetooth or WIFI signals; and other device information such as type of browser, telecom operators, device language, device time zone, device application list, unique application number (s),mobile push code, mobile phone Brand.

Log and operation log information: records of the use of our products or services, the operation records of your use of various functions of the product, such as registration time, recent login time, logout time, time and number of device additions, video viewing, recording, photographing, intercom, Use of mute, timing function, number of verification code requests, video/photo download records, crash information, and information about your IP address, download, installation, or use of mobile applications and software.​

Location information: When you turn on your smart device location function and use our location-based services, we may collect and process information about your actual location, so that you will be able to access services without manually entering your own geographic coordinates. We use various technologies to determine your location, including IP addresses, GPS and other sensors that can provide relevant information (such as information about nearby devices, Wi-Fi access points and base stations).

Information regarding the environment captured by the camera: including indoor layout, surrounding items, pets, and individuals.

Voice information: the voice information that you produce when you use remote conversation functions, voice information of other individuals having remote conversations with you via our smart device and voice information that you produce when you use the smart voice control function.

In addition to the information you directly provide to us, we may also collect information about your use of our services through your device and other means, so as to analyze the status of your use of our products.

1.3 Information collected by third parties

When you log in to Nooie using a third-party account, we shall, based on your authorization, obtain your nickname, mobile phone number, email address, gender, photo, birth date, domicile, age, current city where you are located and personal statements you provided to the third party platform.​

When you purchase our products on a third-party e-commerce platform (Amazon), we obtain information about your nickname on the platform, order number, mailing address, payment amount and payment time from the third-party e-commerce platform and payment service provider.​

Please note that in the specific circumstances disclosed above, certain personal data about you may be received and stored by third party service providers working with us. We will use commercially reasonable efforts to ensure that such third parties do not use this information for any other purpose.

2. How We Use Your Personal Data

We process personal information as necessary for the provision of our Services and the performance of our contract with you.

2.1 Provision of Our Services

When you purchase our products or services through online sales channels, we will use the address and contact information provided by you to deliver the products to you.

As part of providing you with video surveillance features, we will need to process your information including video/picture capture, live video, video storage, video download, mobile phone microphone permission for device intercom function, WIFI information, GPS permission, mobile phone photo album read and write permission, or transmit sounds/voices in real time based on the way you operate the Nooie App or Nooie devices.

2.2 Enable Features Supported by Third Parties

Our products are equipped with optional Amazon Alexa and Google Assistant voice services. When you enable smart voice services, third-party smart voice service providers will collect and process your voice information based on your operations so that our smart devices can respond to your Voice commands. All information collected for this purpose will be collected by third parties directly. For any queries, please refer to their privacy policies.

2.3 Improvement and Development of Our Products

We use your personal data for the maintenance, improvement, or enhancement of the performance of products or services, including for internal quality control, troubleshoot products or services, to improve the security performance of products or services, and to update the function of products or services. We may also conduct statistics and analyze our users’ use of our products or services to understand the use of various functions of our products and services.

2.4 Customer Service Purposes

We will collect and use your information when you initiate a customer service request or inquiry. We will process information including order number, information on the warranty, product information, contact information, contents of the communication between you and us, and any other reviews or feedback you provide.

2.5 Advertising

We may send you news and information about our products or services, product marketing campaigns and promotions, product or service surveys or other similar content. If you do not wish to continue receiving the information above, you may opt out in accordance with the method provided in the information we send to you.

2.6 Comply with Regulation Requirements

We will process your information for compliance with regulation requirements: enforcement and compliance with legal requirements, for the execution of claims, including relevant industry standards, and our policies.​

2.7 Network Security

We may use the information for security purposes, including identity verification, detection and prevention of security incidents, and take necessary recording, auditing, analysis and handling measures according to the law to better prevent security risks such as website phishing, fraud, network loopholes, computer virus, network attack, network intrusion and other security risks and to more accurately identify actions in violation of laws and regulations or the relevant product or service agreements.

We may combine information we obtain about you for the purposes described above. We may also use the information we obtain for other purposes for which we provide specific notice at the time of collection or otherwise with consent.

3. For Users in the EU/EEA Region

Where the General Data Protection Regulation (GDPR) is applicable to Apeman in accordance with the law, the information and the rights specified in this section are available to users residing in the EU/EEA region.​

We act as a “controller” for the Services in which we determine how personal information is utilized in relation to our offerings. Conversely, we function as a “processor” for the Services where we handle personal information solely in accordance with our customers’ instructions, as according to the GDPR.

Right to data portability: You are entitled to obtain a copy of your personal data in structured, commonly used and machine-readable formats to the extent permitted by laws and regulations. For example, if you decide to change to a new service provider, you can move, copy or transfer your personal data between our IT system and their IT system in a reliable, secure and easy way without affecting its use.

Upon providing formal authorization, you can exercise your right to data portability by contacting us via the feedback feature on Nooie app, or by sending an email to support@nooie.com.

Right to rectification of personal information: You have the right to request that we rectify inaccurate personal information concerning you and, depending on the purposes of the processing, you may have the right to have incomplete personal information completed. You can directly rectify and modify part of your personal data on the related function pages of products or services or contact us at support@nooie.com.

Right to erasure/deletion: You have the right to request us to erase some or all of the personal information concerning you. You can directly erase/delete your submitted information in the product interface under your account. You can also contact us via the feedback feature on our platform or by emailing us at support@nooie.com.

Right to restriction of processing: You have the right to request us to restrict the further processing of your personal information. In such cases, the respective information will be marked as restricted. We will store the data and process it for the sole purpose of responding to your request or with your consent in the future. You can submit the request to support@nooie.com.

Right to object: You have the right to object, on grounds relating to your particular situation, such as legitimate interests, exercise of public authority, direct marketing (including data pooling), and statistical reasons, to the processing of your personal information by us. Right to object to direct marketing: You have the right to object to the processing of personal information for direct marketing purposes. Right to withdraw consent: Where we rely on your consent to process your data, you have the right to withdraw consent you have provided to us at any time, and we will stop further processing. Right to refuse automated decision-making: Under the GDPR, you have the right not to be subject to decisions made by automated processing, including profiling, where the decision has a significant legal impact on you. Right to complaint: You have the right to lodge a complaint to an applicable supervisory authority or other regulators if you are not satisfied with our responses to your requests or how we manage your personal information. 4.2 Your Rights

Right to know and access: You have the right to request Apeman to disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or sharing that personal information.
  • Whether we share or sell your personal information, and if so, the categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we disclose your personal information for a business purpose, we will identify the personal information categories that each category of recipient obtained.

Non-discrimination: We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny your goods or services.
  • Charge you different prices or rates for like-goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of like-goods or services.
  • Suggest that you may receive a different price or rate for like-goods or services or a different level or quality of like-goods or services.

Other California Privacy Rights: California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our websites, other products, services and platforms that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.

5. How We Share Personal Information

5.1 Third-Party Service Providers

We may disclose or share your information with third-party service providers that support the provision of our products and services. They are bound by confidentiality agreements and may only use personal information for the purposes for which we disclosed it to them.

Our authorized partners include the following types:

Technical Service Providers: We cooperate with Tuya technical service providers who will provide us with technical support for specific functions of products or services and provide back-end support services for our smart devices. To this end, the Tuya technical service provider will need to obtain your username, email address, log information, operation records, and location information.​

Smart Voice Service Provider: the smart voice feature of our products is supported by Alexa and Google. When you enable such services, your voice information will be collected and processed by Alexa. We do not collect, access or process such voice information. For information on how third-party smart voice service providers collect and process your personal data, please visit the following websites:

Cloud Service Providers: We work with third-party cloud storage service providers to offer video and audio content storage services. Additionally, we provide users with the option to subscribe to cloud service packages that include AI-powered features. For these packages, the relevant information will be shared with the AI service provider. Users can opt-out of the AI features at any time, which will cease the corresponding data sharing.

Message Push Service Providers: We share your email information and device push code with third-party information push service providers to push product or service-related information or notifications to you on our behalf.

5.2 Business Transfer

We may transfer your data to a buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Apeman’s asset, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Apeman may be among the assets transferred.​

5.3 Comply with Law and Regulations

We may share your personal information in certain circumstances, including:

  • To law enforcement authorities, government or public agencies or officials, regulators, and/or any other person or entity with appropriate legal authority or justification for receipt of such information, if required or permitted to do so by law or legal process;​
  • When we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity;
  • When the information is required for the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, or for the enforcement of civil law claims.

6. Children’s Data

6.1 Baby Monitor

Our baby monitors and associated applications are designed for use by parents or guardians. In order to enable the functionality of the baby monitor, we may collect data related to children, including video and audio recordings. However, this data is collected only with your explicit consent, which is obtained when you activate the devices and enable the corresponding features.​

6.2 Other products

In general, our products are not intended for children and are not designed to actively collect data from children under the age of 16, or the applicable age defined by local legislation in the Member States of the European Union. We do not knowingly collect personal information from children under the age of 13. If we become aware that we have inadvertently collected personal information from a child under 16 without the necessary parental consent, we will take immediate steps to delete that information.

If you believe that we may have collected information from or about a child under the age of 16, please contact us immediately.

7. Data Retention and Security

The personal data we collect will be retained for a period necessary to achieve the purpose of collection stated in this Policy, unless a longer retention period is required by law. We will delete or anonymize your personal data when the aforementioned retention period expires. If you cancel your account, we will delete or anonymize your personal data once you have finished account cancellation, unless otherwise required by laws and regulations.​

If we cease to operate some or all of our products or services for special reasons, we will promptly notify you and cease the collection and processing of personal data of the related products or services, and delete or anonymize personal data in our possession in relation to that products or services, unless otherwise required by laws and regulations.​

We take reasonable and practical management and technical measures to protect the information we collect which relates to our products or services. Please note, however, that, although we take reasonable steps to protect your information, no website, internet transport, computer system or wireless connection is absolutely secure.

We have used security measures which are in compliance with industry standard to protect the personal data of you against unauthorized access, public disclosure, use, modification, or damage or loss of data. We will take all reasonably practicable steps to protect your personal data, including the following:​

At present, we have taken measures to ensure the security of data transmission and storage, such as encrypting the data itself or encrypting the documents, and we have adopted strict management measures and access restrictions for our servers, which can only be accessed in our LAN environment.

We have set up authority allocation for internal data access and data export within the company, and we only allow the employees necessary to know the personal data for purpose of processing such information to access such personal data. Where high-sensitivity information such as user privacy is involved, the relevant personal data may be accessed only upon the approval of superior managers;​

The security of your information is very important to us. Therefore, we will continue to ensure the security of your personal data, and implement security measures such as encryption throughout the storage and transmission process to prevent your information from being accessed, used or disclosed without authorization. Meanwhile, the details of some encrypted data are not accessible to anyone other than the user.​

In the event of a personal data security incident, we will, in accordance with the requirements of laws and regulations, promptly inform you of the basic situation and possible impact of the incident, the measures we have taken or will take to deal with it, suggestions that you can take on your own to guard against and mitigate the risks, and our remedial measures to you. We will inform you of the relevant information of the incident in a timely manner by email, letter, telephone, push notice or otherwise. When it is difficult to inform the subject of personal data one by one, we will take reasonable and effective means to issue announcements. At the same time, we will also follow the requirements of the regulatory authorities, and take the initiative to report the handling of personal data security incidents.​

8. International Data Transfer

Your information may be processed where we have facilities or where we have service providers, including mainland China. The data protection rules in these countries may be different from those in the country where you reside.
